Jetlagged Comic cartoons by Kelly Kincaid Usage Policy Agreement:

* All cartoons are copyrighted and cannot be used for any purpose without written approval. Unless otherwise stated, permission is non-exclusive and limited to one-time use only. Each type of specific usage permissions that is granted below is listed below.

* You may not remove any of the identifying information from the cartoon without permission.  This includes the copyright line, copyright permission, meta data, and website address both above the cartoon and inside the cartoon.

* The drawings, text in the balloons and captions of cartoons must always appear in full and unchanged. Cartoons may not be colored or altered in any way except enlarged or reduced proportionally.

* When you purchase a cartoon for reprint use, the only use granted is for the specific usage rights granted.  Usage is not transferable to another person and/or organization.

* All sales are final.

License for Presentation Use
(End User License Agreement)

This agreement governs your rights to use 1 Jetlagged Comic cartoon by Kelly Kincaid in your presentations. It is a legally binding contract between you and Jetlagged Comic cartoons by Kelly Kincaid that grants you one-time use or a one-year use (depending on rights and fees purchased by you and/or your organization) to use Jetlagged Comic cartoons by Kelly Kincaid. Regardless of whether you purchase the one-time or one-year usage rights, rights granted are for use by one individual to use in a presentation. If there will be multiple users of the presentation that contain the cartoons, then additional permissions and usage fees are required. Contact Us for additional usage permission and fees.

One copy of the cartoon may only be included in any printed handouts that accompany your presentation to participants that are present at the presentation. The cartoon used in your presentation may not be given away in electronic form nor may you permit anyone to use the cartoon for any use including presentations. In order to purchase rights to Jetlagged Comic cartoons by Kelly Kincaid, you must agree to the terms of this agreement. After you have read this agreement, you indicate your acceptance of its terms by purchasing the cartoon.

LICENSE AND LIMITATIONS ON USE

Jetlagged Comic cartoons by Kelly Kincaid grants you a non-exclusive, non-transferable, revocable license to use Jetlagged Comic cartoons by Kelly Kincaid in accordance with the following limitations (the "Non-Permitted Uses").

PERMITTED USES

You may use Jetlagged Comic cartoons by Kelly Kincaid in your one-time or permanent use (depending on license fee) presentation(s). The term "Presentations" means a personal or business presentation that you prepare and present for yourself or that you prepare on behalf of your company or an individual in the company and which conveys ideas and presents facts, opinions, and information to others.

NON-PERMITTED USES

  1. The presentation license granted does not allow you to use Jetlagged Comic cartoons by Kelly Kincaid to directly advertise or directly promote any product or service or use Jetlagged Comic cartoons by Kelly Kincaid in any presentation, service, or product that is offered for sale. Please contact us for additional usage rates for this type of use.
  2. The presentation license granted does not permit you to sell or advertise for sale any electronic Internet, or print presentations containing Jetlagged Comic cartoons by Kelly Kincaid. Please contact us for additional usage rates for this type of use.
  3. Jetlagged Comic cartoons by Kelly Kincaid license granted does not permit you to use the cartoon on any project that is inappropriate for minors under the age of 13 to view. The license also prevents the cartoons from being used for any project that Jetlagged Comic cartoons by Kelly Kincaid, finds objectionable. Jetlagged Comic cartoons by Kelly Kincaid always withholds the right to use the cartoons for any reason. If in doubt, Please Contact Us.
  4. Jetlagged Comic cartoons by Kelly Kincaid reserves all rights not specifically granted in this license. Without limitation, the following uses of Jetlagged Comic cartoons by Kelly Kincaid are not permitted under a presentation license:

  6. Use in any commercial, non-profit or personal website or social networking site.
  7. Use in any video and broadcast media distributed over public airwaves, cable, satellite, or closed circuit system.
  8. Electronic downloading or copying by others.

TERM

The license granted under this agreement is the specified posting time (depending on the usage indicated in the order)from the date you licensed Jetlagged Comic cartoons by Kelly Kincaid.

License for Website, Intranet site, Blog or Social Networking site Use
(End User License Agreement)

This agreement governs your rights to post Jetlagged Comic cartoons by Kelly Kincaid for use on your website, intranet site, blog or social networking site. It is a legally-binding contract between you Jetlagged Comic cartoons by Kelly Kincaid that grants a specific length of time to post the cartoon online (depending on rights and fees submitted by you and/or your organization) to use Jetlagged Comic cartoons by Kelly Kincaid files that you have selected. Any other usage requires additional permissions and usage fees. Contact Us for additional usage permission and fees.

The cartoon posted on your website, intranet site, blog or social networking site may not be given away in electronic format or downloads. Contact Us  for additional usage permission and fees if you wish this type of usage.

The license granted under this agreement is the specified posting time (depending on the usage indicated in the order)from the date you licensed Jetlagged Comic cartoons by Kelly Kincaid.

License for Printed and/or Electronic Delivery of materials containing cartoon(s)
(End User License Agreement)

This agreement governs your rights to use Jetlagged Comic cartoons by Kelly Kincaid for use in your printed material and/or Electronic Delivery of materials . It is a legally-binding contract between you and Jetlagged Comic cartoons by Kelly Kincaid that grants you one-time to print or send electronically the licensed quantity of the materials. Any other usage requires additional permissions and usage fees.  Contact Us for additional usage permission and fees.

The cartoon containing the printed materials and/or Electronic Delivery of materials may not be given away so that additional people can make additional copies (print or electronic versions) for use in their materials. Contact Us for additional usage permission and fees.

In order to purchase rights to Jetlagged Comic cartoons by Kelly Kincaid, you must agree to the terms of this agreement. After you have read this agreement, you indicate your acceptance of its terms by purchasing the cartoon. All sales are final.

LICENSE AND LIMITATIONS ON USE

Jetlagged Comic cartoons by Kelly Kincaid grants you a non-exclusive, non-transferable, revocable license to use Jetlagged Comic cartoons by Kelly Kincaid in accordance with the following limitations (the "Non-Permitted Uses").

PERMITTED USES

You may use Jetlagged Comic cartoons by Kelly Kincaid one-time in your printed/electronic materials up to the quantity that you have licensed the rights for in a single printing and/or distribution. The term "Printed Materials" means personal or business printed/electronically created material that you prepare and print for yourself, your clients, or that you prepare and print on behalf of your company or an individual in the company and which conveys ideas and presents facts, opinions, and information to others.

NON-PERMITTED USES

  1. The printed/electronic material license granted does not allow you to use Jetlagged Comic cartoons by Kelly Kincaid on a product or service that is being sold. Please contact us for additional usage rates for this type of use.
  2. The printed/electronic material license granted does not permit you to use Jetlagged Comic cartoons by Kelly Kincaid for use in an advertisement appearing in a magazine, newsletter, newspaper or any other vehicle promoting your company. Please contact us for additional usage rates for this type of use.
  3. The printed material license granted does not permit you to use Jetlagged Comic cartoons by Kelly Kincaid for use in a book published by a third-party or established book publisher. Please contact us for additional usage rates for this type of use.
  4. The printed/electronic material license granted does not permit you to Jetlagged Comic cartoons by Kelly Kincaid in presentations. Please see section above “Use for Presentations License” for this type of use.
  5. The printed/electronic material license granted does not permit you to sell or advertise for sale any electronic, internet, or print printed materials containing Jetlagged Comic cartoons by Kelly Kincaid. Please contact us for additional usage rates for this type of use.
  6. Jetlagged Comic cartoons by Kelly Kincaid license granted does not permit you to use the cartoon on any project that is inappropriate for minors under the age of 13 to view. The license also prevents the cartoons from being used for any project that Jetlagged Comic cartoons by Kelly Kincaid finds objectionable.   12. Digital files, CD Roms, or any other medium that has or has not been invented at the time of sale.
  13. Use in any presentation.

TERM

The license granted under this agreement is the specified posting time (depending on the usage indicated in the order) from the date you licensed Jetlagged Comic cartoons by Kelly Kincaid.

License for Education Use – Trainers, Teachers and Students k-12, Corporate Training, College and Graduate School for use in the classroom only. (End User License Agreement)

This agreement governs your rights to use Jetlagged Comic cartoons by Kelly Kincaid for use us by a trainer, teacher or student K- 12, Corporate Training, College and Graduate School. It is a legally-binding contract between you and Jetlagged Comic cartoons by Kelly Kincaid that grants you one-year license to use the cartoons for use in the classroom only. Any other usage requires additional permissions and usage fees. Contact Us for additional usage permission and fees.

The cartoon containing the printed material may not be given away in electronic format to any additional people except for students for usage as a classroom assignment or by students to their teacher for usage as a classroom assignment. Contact Us for additional usage permission and fees.

In order to purchase rights to Jetlagged Comic cartoons by Kelly Kincaid, you must agree to the terms of this agreement. After you have read this agreement, you indicate your acceptance of its terms by purchasing the cartoon. All sales are final.

LICENSE AND LIMITATIONS ON USE

Jetlagged Comic cartoons by Kelly Kincaid grants you a non-exclusive, non-transferable, revocable license to use Jetlagged Comic cartoons by Kelly Kincaid in accordance with the following limitations (the "Non-Permitted Uses").

PERMITTED USES

You may use Jetlagged Comic cartoons by Kelly Kincaid as a teaching tool.  This license is not transferable and can only be used by one teacher or one student.

NON-PERMITTED USES

  1. The education license granted does not allow you to use Jetlagged Comic cartoons by Kelly Kincaid on a product or service that is being sold. Please Contact Us for additional usage rates for this type of use.
  2. The education license granted does not permit you to use Jetlagged Comic cartoons by Kelly Kincaid for use in an advertisement appearing in a magazine, newsletter, newspaper or any other vehicle promoting your company. Please contact us for additional usage rates for this type of use.

Jetlagged Comic cartoons by Kelly Kincaid always withholds the right to use the cartoons for any reason. If in doubt, Please contact us.
  7. Jetlagged Comic cartoons by Kelly Kincaid reserves all rights not specifically granted in this license. Without limitation, the following uses of Jetlagged Comic cartoons by Kelly Kincaid are not permitted under an education license:
  8. Use in any magazine, printed publication newspaper, book or multimedia product or service not part of a classroom project.
  9. Use in any commercial, non-profit or personal website or social networking site except a teacher’s or student’s website specifically used for a classroom assignment.
  10. Use in any video and broadcast media distributed over public airwaves, cable, satellite, or closed circuit system except a teacher’s or student’s use for a classroom project.
  11. Electronic downloading or copying by others.
  12. Digital files, CD Roms, or any other medium that has or has not been invented at the time of sale.
  13. Use in any presentation and or newsletter or printed publication except for use by a teacher’s or student’s for a classroom project.

TERM

The license granted under this agreement is for indefinite use by one teacher and is non-transferable.

WARRANTIES AND DISCLAIMER OF WARRANTIES

THE CARTOONS ARE PROVIDED SOLELY ON AN "AS IS" BASIS. EXCEPT AS EXPRESSLY PROVIDED HEREIN, JETLAGGED COMIC CARTOONS BY KELLY KINCAID AND ITS PARENT, SUBSIDIARIES, LICENSORS, DISTRIBUTORS, SUPPLIERS AND AFFILIATES: (1) DO NOT MAKE AY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, WITH RESPECT TO THE CARTOONS; (2) EXPRESSLY DISCLAIM ANY IMPLIED WARRANTIES OF MERCHANTABILITY, SATISFACTORY QUALITY, AND/OR FITNESS FOR A PARTICULAR PURPOSE; AND (3) DO NOT WARRANT THAT THE CARTOON OR YOUR USE THEREOF WILL BE UNINTERRUPTED OR ERROR FREE. YOUR SOLE AND EXCLUSIVE REMEDY AND WARRANTY AND JETLAGGED COMIC CARTOONS BY KELLY AND ITS PARENT’S, SUBSIDIARIES’, LICNSORS’, DISTRIBUTORS’, SUPPLIERS’ O AFFILIATES’ SOLE OBLIGATIONS AND LIABILITY HEREUNDER WITH RESPECT TO THE CARTOONS WILL BE, AT JETLAGGED COMIC CARTOONS BY KELLY KINCAIDS‘S SOLE OPTION, REPLACEMENT OF THE DEFECTIVE CARTOONS OR A WHOLE OR PARTIAL REFUND OF THE FEE PAID BY YOU FOR THE DEFECTIVE CARTOONS IN ACCORDANCE WITH OUR REFUND POLICY.

LIMITATION OF LIABILITY

EXCEPT AS EXPRESSLY PROVIDED IN THIS AGREEMENT, IN NO EVENT WILL JETLAGGED COMIC CARTOONS BY KELLY, ITS PARENT, SUBSIDIARIES, LICENSORS, DISTRIBUTORS, SUPPLIERS OR AFFILIATES BE LIABLE FOR ANY DIRECT, CONSEQUENTIAL, EXEMPLARY, SPECIAL, INDIRECT, INCIDENTIAL OR PUNITIVE DAMAGES OR LOST PROFITS, HOWEVER CAUSED, ARISING FROM OR RELATING TO THIS AGREEMENT OR THE SUBJECT MATTER OF IT UNDER ANY THEORY OF LIABILITY, INCLUDING BUT NOT LIMITED TO (1) DAMAGES ARISING FROM LOSS OF DATA; AND (2) DAMAGES ARISING FROM YOUR USE OF THE CARTOONS IN VIOLATION OF THIS AGREEMENT, INCLUDING THE NON-PERMITTED USES. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF IMPLIED WARANTIES OR LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO SUCH EXCLUSIONS OR LIMITATIONS MAY NOT APPLY TO YOU.

INDEMNIFICATION

You will defend and indemnify Jetlagged Comic cartoons by Kelly Kincaid and its parent, subsidiaries, licensors, distributors, suppliers and affiliates (and their respective officers, directors, employees and agents) against any and all claims, losses, damages, liabilities, deficiencies, judgments, assessments, fines, costs and other expenses (including reasonable attorneys' fees) arising from or relating to your use of the Jetlagged Comic cartoons by Kelly Kincaid in violation of this agreement.

TERMINATION

This agreement and your rights to access, download and use the Jetlagged Comic cartoons by Kelly Kincaid are subject to immediate termination, without notice, if you breach any provision of this agreement or if you use the Jetlagged Comic cartoons by Kelly Kincaid in violation of this agreement. If such termination without notice is expressly prohibited by applicable law, then such termination will occur upon notice of any such breach. Upon termination, you must: (i) cease all use of Jetlagged Comic cartoons by Kelly Kincaid, (ii) destroy all electronic files of Jetlagged Comic cartoons by Kelly Kincaid and (iii) return any physical copies of Jetlagged Comic cartoons by Kelly Kincaid to Jetlagged Comic by Kelly Kincaid.

CHOICE OF LAW AND VENUE

This agreement will be governed by the laws of the state of Washington, without regard to its conflicts of law principles. You agree that any claim or dispute arising out of or relating to this agreement will be brought in an appropriate state or federal court located in King County, Washington. You agree to submit to the exclusive jurisdiction and venue of these courts and waive any jurisdictional, venue or inconvenient forum objections to such courts.

SURVIVAL

The paragraphs entitled "INDEMNIFICATION" and "CHOICE OF LAW AND VENUE" will survive termination of this agreement.

ENTIRE AGREEMENT AND SEVERABILITY

This agreement constitutes the entire agreement between you and Jetlagged Comic cartoons by Kelly Kincaid with respect to its subject matter. If any part of this agreement is found invalid or unenforceable by a court of competent jurisdiction, the remainder of this agreement will be interpreted so as to reasonably effect the intention of the parties.
